DAVID ROBERTSON DECORATORS 2025 LIMITED — TERMS AND CONDITIONS OF SERVICE
These terms and conditions are strictly confidential and are not to be passed on to any third parties other than the "client". If any provision of these terms and conditions is invalid, void, illegal or unenforceable, the validity, existence, legality and enforceability of the remaining provisions is not affected, prejudiced or impaired.
1. TERMINOLOGY
"We", "our" and "us" refer to David Robertson Decorators 2025 Limited (David Robertson Decorators — NZBN: 9429053312181). "You", "property owner" and "customer" refer to the client who has contracted our services.
2. CUSTOMER OBLIGATIONS
During the term of the agreement, you agree to:
(a) give clear and detailed instructions regarding the painting services you require; (b) pay all service fees as invoiced, on time and in full; (c) provide a safe working environment and advise us of any hazards or dangers at the project premises; (d) provide clear, unobstructed access to the premises and its amenities, including power and water; (e) pack away breakables, fragile items and other valuables at the premises; and (f) obtain any authority needed from the property owner for the work to commence, with particular regard to paint odour affecting workers, tenants, neighbours or the public, and to smoke detectors/alarms and air conditioning.
3. QUOTES
- Our quotes are valid for 30 days from the date of receipt, unless we agree otherwise in writing.
- Prices are stated exclusive of GST, with GST shown separately on the quotation.
- A quote is accepted when you approve it electronically through our quoting system, or when you sign and return a copy to our office. Electronic approval has the same effect as a signature.
- In accepting our quotation, you accept these terms and conditions.
- All quote and invoice matters are to be discussed directly with the manager or director of David Robertson Decorators.
- If applicable local, government or council laws or regulations are introduced or varied during the project, resulting in previously-not-included charges being imposed, we reserve the right to adjust our pricing for the affected works. We will discuss any such adjustment with you before proceeding.
4. COLOUR SELECTION
- You may view colour swatches on the Dulux or Resene websites, or ask us for guidance.
- We require your colour name and sheen confirmed in writing before your project is scheduled. We cannot allocate start dates until colours are confirmed.
- We accept no responsibility for your choice of colours.
- If you change a colour after work has commenced, any associated costs, including labour, will be charged to you in full.
5. ADDITIONAL WORK & VARIATIONS
- Any additional work or variation not stated in your quote is charged at $80 per hour plus GST.
- Please read your quote carefully and tell us before work commences if anything is unclear.
- If we encounter unforeseen damage or repair needs during the project, we will discuss them with you before proceeding, as they may involve costs not included in the original quotation.
6. TIMINGS
- We will always endeavour to follow agreed timelines.
- All project timings are subject to weather conditions and to circumstances outside our control.
- We accept no responsibility for loss arising from a change to project timings.
- We may cancel a provisional start date if the quote has not been accepted and the deposit has not been paid.
7. WEATHER CONDITIONS
- We may postpone a project due to adverse weather conditions.
- Start dates and completion times are subject to weather conditions.
- Weather conditions are those unsuitable for the application and/or preparation of painted surfaces.
8. PAYMENT STRUCTURE
Payment is structured across three milestones:
- Booking deposit (25%) — payable on acceptance of the quotation, to secure your place in our schedule and cover materials. The booking deposit is non-refundable once paid, as we allocate crew time and order materials against your project from that point. If we cancel or are unable to proceed with your project, your deposit is refunded in full.
- Project kick-off payment (25%) — payable on the first day of work.
- Completion balance (50%) — payable once all work is complete and you are satisfied with the results.
9. PAYMENT TERMS
- All invoices are payable within 5 business days of signoff, so we can keep materials and scheduling moving for the next job.
- We may request and receive a weekly progress payment during any project.
- We may: (a) suspend work on the project if you do not pay an invoice, or any other fee payable under this agreement, on time or in full; and/or (b) charge interest at 20% per annum on any account unpaid for more than 15 days.
- If we engage a lawyer or collection agency to recover unpaid money, you are liable for our costs of doing so.
10. WARRANTIES / GUARANTEES
- Our work carries the Master Painters New Zealand 5-Year Guarantee, covering surface preparation and surface coating applied to meet AS/NZS 2311 — the painting of buildings. This guarantee is administered by Master Painters New Zealand and is subject to that scheme's terms.
- Where anything in these terms conflicts with the Master Painters New Zealand Guarantee, the Master Painters Guarantee prevails.
- Nothing in these terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 where you are acquiring our services as a consumer.
- All warranties are subject to you carrying out general maintenance on your property so that our work is kept to a reasonable standard.
- We accept no responsibility for work that has been altered, touched up or tampered with by you or any third party. Warranties are void in that case.
- Warranty claims must be lodged with our office in writing.
- Where a claim arises from workmanship or product failure, we will rectify the issue and cover the cost of labour to do so. You may be required to cover material costs.
- We do not warrant the condition, permanence or quality of substrates not originally sealed by us, including plaster ceilings, walls, woodwork and weatherboards.
- Where timber weatherboard cladding cannot be taken back to bare timber during preparation, we do not warrant the preparation or coating on that cladding. We will advise you if this applies to your property before work commences, and will discuss options for addressing it.
- We do not warrant fading, peeling or blistering of dark colours on exterior projects. Dark colours may include reds, blues, greens, greys and blacks. Warranty is not offered for line marking or concrete painting unless explicitly stated.
- We do not warrant cracking, settlement cracking, water stains, rust, or peeling of previously painted surfaces that have not been sealed using an oil-based pigmented sealer.
- Varnish, stain, polyurethane and semi-transparent coatings carry a 12-month warranty.
11. PAINT PRODUCTS
- We may alter or change products used on a project without prior notice.
- All paint and materials remain our property until all balances are paid in full.
- We may remove unused paint and materials from a site before, during or after completion.
- We do not accept responsibility for yellowing of gloss enamel products.
- We may pass on supplier price increases occurring during a project. These may occur without notice.
12. COMPLAINTS
- If you are not satisfied with any part of our work, please tell us. Raise it with our office in writing within 90 days of project completion and we will address and remedy any justified issue as soon as possible. This clause does not limit your rights under clause 10, or under the Consumer Guarantees Act 1993.
- We hold public liability insurance covering damage to your premises caused directly by our team. Any such damage must be reported within 48 hours.
- We value open and honest feedback, and it's part of how we've built our reputation. David Robertson Decorators has served Christchurch since 1991, and our work is reflected in over 126 five-star Google reviews from real clients. If any concern arises during or after your project, we ask that you raise it with us directly and promptly so we can address it quickly and fairly — most issues are resolved this way well before they'd ever need to become a public review.
13. PROMOTIONAL MATERIAL
We may capture photographs and video of your project during and after completion, to showcase our work on our website, social media and other marketing materials. We may also use information from customer surveys and online reviews. We take care to ensure no personal or identifying information is included unless we have your explicit permission. If you would prefer your project not to be featured, please let us know before work commences and we will not use it.
14. GOVERNING LAW
These terms and conditions are governed by and construed in accordance with the laws of New Zealand. Any disputes arising from these terms are subject to the exclusive jurisdiction of the courts of New Zealand.
15. AMENDMENTS
We may amend these terms and conditions at any time. The terms in force are those attached to your accepted quotation.
